  1. What is the Portable Emergency Generator Program?
    NYSERDA has established this Program to provide, deploy and install portable emergency generators (generators) to strategically located gas stations in the event of a declared energy or fuel supply emergency.
  2. Which gas stations are eligible to apply?
    Stations addressed by Agriculture and Markets Law Section, Article 16, Section 192-h, Alternate Generated Power Source at Retail Gasoline Outlets are eligible to apply. Participation in the Program through NYSERDA is voluntary and other alternatives are available to stations to ensure compliance with Section 192-h. Program participation does require that a gas station has previously installed an appropriate transfer switch.
  3. If I did not participate in the Gas Station Back-Up Power Program, can I still participate in the Portable Emergency Generator Program?
    Yes. If the gas station is required to comply with Agricultural and Markets Law Article 16, Section 192-h Alternate Generated Power Source at Retail Gasoline Outlets and has installed a transfer switch, it may participate in the Portable Emergency Generator Program.

Click the “Apply for Generator Program” button to be taken to the Program information and application. Upon receiving the online application, NYSERDA will review the application and work with the owner/operator to develop a rental agreement.
  5. What information will I need to complete the application?
    You will need to provide your business and contact information, gas station operational information, and a Certificate of Liability Insurance.
  6. Do I need proof of insurance?
    A Certificate of Insurance for a minimum of $1,000,000 in liability coverage that lists "NYSERDA and the State of New York" as additional insured is required. Refer to the sample Certificate of Insurance [PDF]. Note that this is a sample. Please consult with your insurance company to complete the form properly.
  7. If I am unable to complete the application immediately can I save my progress and come back to it later?
    Yes. At the bottom of the application there is a “SAVE” option. You can save your work and come back to it later. Once you click that option, an email will be sent to you with instructions on how to complete the form from where you left off. Note that you will have 7 days to go back and complete the form.
  8. Will generators be provided to all gas stations?
    No, NYSERDA, in consultation with the Commissioner of NYS Division of Homeland Security and Emergency Services, will prioritize such gas stations as are most essential to public safety and well-being during the energy or fuel supply emergency.
  9. If the Program is unable to deliver a generator at the time of a Declared Emergency, are there penalties on the dealer?
    No. If a generator is not supplied to a gas station participating in the NYSERDA program due to prioritization, it would not be penalized.
  10. If a gas station has a private contract to have a generator delivered and the contractor is unable to deliver the generator, what will be the penalty?
    The station would be subject to penalties up to $1,500 per day; however, mitigating factors would be considered.
  11. How will I request a generator during a Declared Emergency?
    Participating gas stations located in an area affected by a declared energy or fuel supply emergency will call a toll free number to request a generator. NYSERDA will provide the toll free number with the rental agreement. Generators will be systematically deployed to prioritized stations.
  12. What will I have to pay for the generator?
    Gas stations receiving a generator will be charged a rental fee of $1,500 per week, plus the cost of generator fuel. The rental fee will cover cost of generator supply, deployment, connection to the gas station, and routine and emergency maintenance.
  13. If I receive a generator from NYSERDA, am I required to maintain any set business hours?
    No. The State will not require set business hours. However, generator deployment will be prioritized to gas stations most essential to public safety and well-being. Gas stations open 24 hours a day will likely receive higher priority. Further, NYSERDA will require 24-hour a day generator operation for reasons of generator and gas station safety and operational effectiveness; unless mitigating safety hazards prevent generator operation or the gas station runs out of retail fuel to sell. NYSERDA recommends generator attendance 24 hours a day for reasons of generator, generator fuel, and generator power theft and safety.
