CES LSE Obligations

Load Serving Entities (LSEs) are required by New York State to fulfill their various compliance obligations under the Clean Energy Standard (CES) and Other LSE Obligations approved by the New York State Public Service Commission (PSC). The Clean Energy Standard (CES) requires LSEs to meet their obligations by purchasing their load share of Tier 1 and Tier 4 renewable energy certificates (RECs) and zero-emissions credits (ZECs) from NYSERDA. The Other LSE Obligations include the Bulk Energy Storage (BES) Program which requires LSEs to fund the BES Program.

Through the compliance process in New York Generation Attribute Tracking System (NYGATS), LSEs can track and reconcile their obligations monthly and yearly obligations.

Compliance processes for each program is similar, though they are on different timelines. The compliance year for Tier 1, Tier 4 and BES programs are based upon a calendar year while the ZEC Program is based upon a fiscal year.

Additionally, data in NYGATS is delayed by five months due to a lag in NYISO’s reporting process.

RES Compliance

NYGATS also provides LSEs with a summary of Tier 1 obligations which shows the latest information on load for the compliance year, the preliminary Tier 1 Rate and the Preliminary Tier 1 Charges. During the Tier 1 Reconciliation, the summary will be updated with the Final Load Served by the LSE during the compliance year, Final Tier 1 Rate, the Final Tier 1 Charges and the Yearly Reconciliation amount.

NYSERDA’s Tier 2 Program ended December 31, 2023.

ZEC Compliance

NYGATS also provides LSEs with a summary of ZEC obligations which shows the latest information on load for the compliance year, the preliminary ZEC Rate and the Preliminary ZEC Charges. During the ZEC Reconciliation, the summary will be updated with the Final Load Served by the LSE during the compliance year, Final ZEC Rate, the Final ZEC Charges and the Yearly Reconciliation amount.
