Records Counsel - Albany Office (#564)

New York is leading the nation in the fight on global climate change and the transition to a clean energy economy.  NYSERDA is on the front lines of this work and serves as one of the lead agencies tasked with meeting the State’s nation-leading goals, including 100% clean electricity by 2040, 70% renewable energy by 2030 and developing a roadmap to a carbon neutral economy. 

The Records Counsel role at the New York State Energy Research and Development Authority (NYSERDA) is a multidisciplinary role that administers NYSERDA’s obligations under the Public Officers Law’s Freedom of Information Law provisions and the Education Law’s provisions relating to retention and archiving of state records.  Records Counsel will also serve as the President-designated roles of Records Access Officer and Records Management Officer.

Primary Responsibilities 

  • Receiving and processing incoming Freedom of Information Law requests
  • Overseeing the collection and review of responsive records from custodians throughout the Authority’s staff statewide
  • Handling written and telephonic communications with FOIL requesters; enterprises seeking to invoke FOIL provisions relating to trade secret, critical infrastructure information, or other exemptions; and other parties
  • Performing legal research regarding novel questions of law related to emerging issues
  • Collaborating and strategizing with other state and federal agencies regarding access to public records and promote the availability of records on Open NY
  • Overseeing the Authority’s compliance with Education Law and affiliated regulatory provisions regarding proper retention and archiving of NYSERDA records
  • Overseeing Records Management Coordinators responsible for department-specific records management
  • Advising the General Counsel and President/Chief Executive Order on matters related to the Freedom of Information Law, appeals and litigation, if any
  • Training NYSERDA staff on FOIL and Records Management obligations
  • Liaising with the public, Authority and Executive Chamber staff, State Archives staff, and outside counsel as needed
  • Performing other responsibilities as assigned 

Minimum Qualifications

  • Doctor of Jurisprudence degree from an accredited law school and license to practice law in New York State
  • One year of experience in a legal records management role
  • Strong verbal and written communication skills; ability to manage an active docket of FOIL requests and collaborate with colleagues constructively and efficiently
  • Proven ability to build trust, confidence, respect, and effective working relationships among individuals at all levels of the organization and with stakeholders and business partners
  • Possession of a deep appreciation for the inter-relationship of the needs and perspectives of internal and external stakeholders in supporting the mission of NYSERDA
  • Ability to handle highly sensitive matters with absolute integrity and discretion
  • Able to handle stressful situations with measured calmness and decisiveness
