Environmental Impact Statement Documents

NYSERDA’s decision for continuing the cleanup at the Western New York Nuclear Service Center is presented in the Findings Statement, as required under New York State Environmental Quality Review Act.

Issued to the public on January 29, 2010, by DOE and NYSERDA, the FEIS for decommissioning activities at the West Valley site.

Foreword to the FEIS, presents NYSERDA’s significant concerns with the technical analyses presented in the FEIS.

The review focuses on DOE responses to specific NRC comments, most of which address the question of whether the DOE cleanup goals adequately protect each potential receptor from each potential residual radioactive material source within the Phase 1 cleanup scope without compromising the decision-making flexibility for the Phase 2 cleanup.

It provides the results of a probabilistic risk assessment for managing the State-Licensed Disposal Area in place for up to 30 more years.

It presents the results of the review of the 2008 Preliminary Draft of the West Valley Decommissioning EIS by an independent expert review team convened by NYSERDA.

It presents the results of the review of the 2005 Multi-Agency Review Draft of the West Valley Decommissioning EIS by an independent peer review group convened by NYSERDA and the U.S. Department of Energy.

Future Planning Documents

The Second Supplemental Agreement covers the relationship, procedures, cost responsibilities, rights and obligations as between NYSERDA and DOE for identification, implementation and management of the Phase 1 Studies.

The Phase 1 Studies Guidance details guiding principles, core values, and the processes by which NYSERDA and DOE will interact with and solicit input from public stakeholders, regulatory agencies and scientific experts. NYSERDA and DOE will consider this input when making decisions on Phase 1 Study implementation and cleanup activities.

The Final Focused Corrective Measures Study (CMS) analyzed the potential for releases and options for containment of hazardous constituents from the SDA. The recommended CMS alternative is consistent with the Phased Decision-making Alternative selected by NYSERDA and the U.S. DOE. NYSERDA’s responses to the public comments on the Draft Focused CMS are addressed in the Responsiveness Summary (Section 6) of the document.

West Valley Phase 1 Studies

  • Phase 1 Study Website - NYSERDA and DOE contracted with Enviro Compliance Solutions (ECS), Inc. to develop a website devoted exclusively to the Phase 1 Studies Process. This website (http://westvalleyphaseonestudies.org) will be a repository for all important documents, updates, announcements, etc. Stakeholders can also register on the website (see link above) to join a notification list for Phase 1 Studies updates, including meeting information.
